Who needs a Workers Compensation policy?
Section 155 of the Workers Compensation Act 1987 requires employers to take out a workers compensation insurance policy to cover their workers. This policy covers any of the employer's workers (whether permanent or casual) in the event of them suffering a work-related injury or illness.
If a sole trader establishes a Pty Ltd company, the company becomes the 'employer' and a policy must be taken out under the company name to cover the 'working director"' who was formerly the sole trader, plus any other workers they may have.
If the business is operating as a sole trader or partnership it is suggested you take out a personal accident and illness policy or an income protection policy, in case you are unable to work. Please note if you have any employees you are required by law to have a valid workers compensation policy to cover these staff.

How to change your Workers Compensation Insurer? |
|

For members interested in changing to the MTA/QBE Scheme you need to download the 'request for cover form' and 'cancellation request form', once completed fax back to MTA on 02 9212 6889.

What if my policy is already with QBE ? |
|
| |
Whilst your policy is with QBE, you are a QBE Direct Client and this is not a part of the MTA/QBE Workers’ Compensation Scheme.
In order to be a part of the MTA/QBE Workers’ Compensation Scheme, you need to download the letter of Authority to enable your policy to be moved across to the MTA/QBE Workers’ Compensation Scheme.

By changing Insurers will this effect my Workers Compensation Premium? |

The premium does not differ from insurer to insurer as this is determined by the WorkCover Authority NSW, however the level of service offered by QBE has proven to be superior to other providers in the market. Since 2002 QBE has been MTAs preferred workers compensation provider with the vast number of MTA members making the switch to QBE. |

What happens next? |
|
| |
There are several steps involved.
1/ MTA will forward the request forms to the respective insurers.
2/ QBE will send you a proposal form for your completion.
3/ You will need to forward to the previous insurer your Declaration of Actual Wages Paid for the 12 month period.
4/
Do not complete your Estimate of Wages for the next period, as this will be completed on QBE's Proposal Form.

When are payments due? |
|
| |
This will vary depending on the annual premium payable. The WorkCover Authority NSW has recently made changes to the instalment process, effective from 30 June 2007. This means that if your annual base tariff premium payable is:-
- Under $1,000 - payable in one lump sum;
- Over $1,000 and under $5,000 you are entitled to pay in a lump sum or quarterly instalments;
- Over $5,000 – you can elect to either pay by quarterly instalments, monthly instalments or lump sum.
If you are eligible to pay in instalments, you also have the option to pay by direct debit, but you need to make the first payment to the insurer to signify which instalment option you have selected and the remaining instalments will be deducted.
IMPORTANT NOTE: When paying by instalments – You need to ensure that the money is received by the insurer before the due date – Failing this – The entire remaining premium will become payable. |

How to lodge a claim with QBE? |
|
| |
(note: all existing claims with previous insurers will be administered by the previous insurer)
If one of your employees suffers a work-related injury, you need to:
1/ Make an Early Notification Report of the injury to QBE as soon as possible and to avoid the Excess, notification needs to be within 5 days of when YOUR BUSINESS was notified, this includes weekends. The excess payable is equivalent to the injured workers gross weekly wage.
2/ Use the on-line notification form (see link below) or contact the nearest QBE Workers' Compensation Branch (your employee may make this notification also).

3/ Forward the required Report of Injury Forms for you and your employee to the nearest QBE Workers' Compensation Branch. Once you have notified QBE of an injury, they will:
a) Implement QBE case management strategies and;
b) Assess the claim and notify you of the liability decision |

Summary of important Guidelines on Workers Compensation |
|
| |
- Estimate of Wages need to be provided annually (and within 2 months of renewal date to avoid an automatic renewal with an extra 30% added onto the previous years wages);
- Declaration of Wages need to be provided annually;
- The premium does not vary from insurer to insurer;
- Instalment options (for base tariff premiums over $1,000) are offered;
- Deposit Instalments not received PRIOR to the due date no longer qualify for the instalment option;
- Interest charges apply for late payment(s);
- Penalties imposed for non-compliance;
- You can change prior to your expiry date, once a year only.
