Fair Trading Infringement Notices

The MTA NSW met with NSW Fair Trading to discuss infringement notices being issued against repairers who do not have a Form 2 Prescribed Parts Register or who are using a non-qualified worker to carry out repair work.

As the legislation introducing the Form 2 Register dates back to 2014, NSW Fair Trading has indicated that the industry has had sufficient time to implement the necessary changes for compliance purposes.

The need for repair work to be carried out by workers who have the appropriate qualifications has been the law since 1980.

The fines applicable and a description of the breach will appear on the NSW Fair Trading website against the business name. An example of both types of infringement notices is below.

If you require clarification on your compliance obligations, please contact your MTA NSW Divisional Manager for assistance.
